Fabeleka — Terms of Use

Welcome to Fabeleka. The Terms of Use govern your access to and use of the Fabeleka website, mobile applications, and related services (collectively, the “Service”). Accuracy: We do not guarantee that the Service will be uninterrupted, secure, error-free, or that content is accurate or up to date.

9. Limitation of liability

To the extent permitted by law: Fabeleka (and its officers, directors, employees, agents, affiliates, successors, and assigns) will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages (including lost profits, lost sales, loss of data) arising out of or related to your use of the Service.
Aggregate cap: Our total aggregate liability arising from or related to these Terms or the Service will not exceed the amount you paid to Fabeleka in the 12 months preceding the claim (or, if you have not paid us, a nominal sum such as $100 or the maximum allowed by law).
Exceptions: Some jurisdictions do not allow limitation of liability for certain damages; where such limitations are not permitted, liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fabeleka and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.

11. Account suspension and termination

Suspension/termination: We may suspend or terminate your access for violations of these Terms or for business reasons. We may also remove content at any time.
Effect of termination: Termination does not limit our rights to pursue other remedies. Provisions that by their nature survive termination (e.g., ownership, disclaimers, limitations of liability, indemnities) will continue.

Disputes & Refunds

Liability
